BrainHook — Terms of Use

1. Acceptance of Terms

By downloading, installing, or using BrainHook ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the App.

2. Description of Service

BrainHook is an AI-powered mnemonic generator that helps users turn study materials (PDF, Word, PowerPoint, or plain text) into acronyms, acrostics, and visual anchors using artificial intelligence.

The App processes your study content via Google's Gemini AI to generate memory aids. AI-generated output is provided as-is and may not always be accurate, complete, or appropriate for your specific needs.

3. Eligibility

You must be at least 13 years old to use BrainHook. If you are under 18, you confirm that you have permission from a parent or legal guardian.

If you are using BrainHook in a country with stricter age requirements, you must meet those requirements.

4. Account Registration

To use BrainHook's features, you may need to create an account using your email, Google account, or Apple ID. You agree to:

• Provide accurate and current information
• Keep your login credentials confidential
• Notify us immediately of any unauthorized account use
• Be responsible for all activity that occurs under your account

5. Free Trial

New users receive 3 free mnemonic generations as a one-time trial. The free trial does not renew or reset. After the 3 generations are used, you must subscribe to BrainHook Pro to continue generating mnemonics.

Saved mnemonics in your library remain accessible even after the trial ends.

6. Subscriptions and Auto-Renewal

BrainHook Pro is offered as an auto-renewing subscription. By subscribing, you agree to the following terms:

• Subscription length and price: Available as monthly or annual plans. Exact pricing is shown in the App and on the App Store / Google Play before purchase.
• Payment: Charged to your Apple ID or Google Play account at confirmation of purchase.
• Auto-renewal: Subscriptions automatically renew at the end of each billing period unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Renewal charge: Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
• Manage or cancel: You can manage subscriptions and turn off auto-renewal in your Apple ID account settings (iOS) or Google Play account settings (Android) after purchase. Deleting the App does not cancel your subscription.
• Refunds: Refund requests are handled by Apple or Google according to their respective policies. We cannot issue refunds directly.

7. User Content

BrainHook allows you to upload study materials (PDFs, documents, text) for mnemonic generation. By uploading content, you confirm that:

• You own the content or have the right to use it
• The content does not violate any third-party rights, including copyright, trademark, or privacy rights
• The content is not illegal, harmful, defamatory, obscene, or otherwise objectionable

Uploaded content is processed by Google's Gemini AI to generate mnemonics. We do not permanently store uploaded files on our servers. Generated mnemonics are saved to your personal library in our database.

You retain ownership of your uploaded content and saved mnemonics.

8. AI-Generated Content Disclaimer

BrainHook uses artificial intelligence to generate mnemonics. AI-generated output may:

• Be inaccurate, incomplete, or misleading
• Contain errors, biases, or outdated information
• Not be suitable as the sole source for academic, medical, legal, financial, or other critical decisions

You are responsible for verifying any information generated by the App. BrainHook is a study aid, not a substitute for professional advice or authoritative sources.

9. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Upload malicious files, viruses, or harmful code
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use the App to generate content that is harmful, abusive, harassing, or discriminatory
• Bypass subscription limits, share accounts, or attempt to access unauthorized features
• Interfere with or disrupt the App's functionality or servers
• Use automated tools (bots, scrapers) to interact with the App

We reserve the right to suspend or terminate accounts that violate these terms.

10. Intellectual Property

The BrainHook app, including its design, code, branding, and features, is the exclusive property of the developer and is protected by copyright and intellectual property laws.

You are granted a limited, non-transferable, non-exclusive license to use the App for personal, non-commercial purposes in accordance with these Terms.

11. Privacy

Your use of BrainHook is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

12. Third-Party Services

BrainHook uses the following third-party services:

• Firebase (Google) — Authentication and database
• Google Gemini AI — AI mnemonic generation
• RevenueCat — Subscription management
• Apple App Store / Google Play — Distribution and payment processing

Your interactions with these services are subject to their respective terms and privacy policies.

13. Termination

We may suspend or terminate your access to BrainHook at any time, with or without notice, if you violate these Terms or engage in conduct we believe is harmful to the App, other users, or our business.

You may stop using BrainHook at any time by deleting the App and your account. Note that deleting the App does not cancel any active subscription — you must cancel through the App Store or Google Play.

Upon termination, your right to use the App ends. Saved mnemonics may be deleted from our servers.

14. Disclaimers

BrainHook is provided "as is" and "as available" without warranties of any kind, express or implied.

We do not guarantee that:

• The App will be error-free, secure, or uninterrupted
• AI-generated content will be accurate or suitable for your needs
• The App will be compatible with all devices or operating systems
• Your use of the App will result in academic or learning success

Use the App at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of (or inability to use) BrainHook, including but not limited to loss of data, loss of profits, academic outcomes, or any other intangible losses.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

16. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

17. Changes to These Terms

We may update these Terms from time to time. Significant changes will be communicated within the App or via email. Continued use of the App after changes take effect constitutes acceptance of the new Terms.

The "Last updated" date at the top of this page indicates when these Terms were most recently revised.

18. Governing Law

These Terms shall be governed by and construed in accordance with applicable consumer protection laws of your country of residence. Any disputes shall be resolved through good-faith negotiation; if that fails, through the courts of competent jurisdiction.
